Dear Rick:
 
As I mentioned to you, when discussing Subject matter with Everett Frye at SJRWMD last week, as Rick Mauldin suggested I do, Everett continued to tell me that Sea Winds was not mentioned in reference Permit. All that he could find was Pond 1, Holiday Inn; Pond 2, north, St. Augustine Ocean & Racquet; and Pond 3, south, St. Augustine Ocean & Racket. I repeated to him what you had told me about the Sea Winds calculations you had done and the fact that there should be a "stub out" in the manhole towards Sea Winds. Everett suggested that I down load the Permit to see if I read it differently.
 
In reading the nice 345 page Document you prepared, I noted that Page 284 (I copied below) shows the outflow line from Pond 3 to the North West rather than to the South West, across Sea Winds Property as built. I guessed that Everett must not have an "as built" drawing and was why we were not communicating.
 
I called Everett this morning, 04/29/2008, and explained the above. We then understood that he and I were talking about two different things. Everett said that the above referenced Permit must be formally changed to reflect the Field Changes that were made. He said once that documentation is submitted, it would take 30 to 45 days for SJRWMD to approve the modification to Permit Number 40-109-84900-1. I asked; after that you can issue a "Letter of Exception" for Sea Winds?  He replied; "likely so".
 
In view of the foregoing, I guess it is up to St. Johns County and Connelly & Wicker, Inc. to submit the required data for the Permit modification. Also, from all of this, I conclude that Sea Winds is dead in the water (or our flood water!) until SJRWMD approves the modification to Permit Number 40-109-84900-1. Then, hopefully we will get our "Letter of Exception" and can give an NTP to our Contractor to connect the Sea Winds lagoons to the St. Johns Co. storm water outflow line.
 
We really appreciate all of your help Rick. If there is any way we can assist you in putting the required data together, we are ready. We desperately need to get our lagoons connected to the out flow line and are eager to close out the Restoration Contract.
